Member Agreement and Waiver Form

aliyamd – A Private Member Association

DEFINITIONS OR GLOSSARY: specific words used in this member agreement to ensure that all has a common meaning before signing.

aliyamd - a Private Membership Association, hereafter referred to as the Association.

Agreement - An arrangement between parties regarding a course of action.

Age of Majority – age when a man or woman is considered an adult.

Consideration - Something of value exchanged between parties.

Incumbent of an office – currently holding a specified (political) office.

NDA means non-disclosure agreement.

Memorandum of Comprehension refers to the terms and conditions agreed to by the member to allow them to access the provision of offerings and benefits of PMA. It further recognizes that the member comprehends that it is entirely their own responsibility to consider the advice and recommendations offered through PMA through consultation, education, mentoring, therapy, treatment or care.

Memorandum of Understanding is an agreement between two or more parties outlined in a formal document. It signals the willingness of the parties to move forward with a contract.

Private Information means any information or material which is provided to or by aliyamd, the Association, resulting from Member participation which is not generally known other than by the Member participating with the Association and which may be obtained through any direct or indirect contact with the Association including but not limited to emails, phone conversations, video conversations, conference calls, social media communications, audio recordings, recorded and/or live-stream videos or webinars or other broadcasts or telecasts, downloads, written work product, documents, samples created by the Association or third parties with which the Association aligns and deals with, including without limitation, documents, research, correspondence samples, educational information processes, procedures, protocols, or intellectual property shared by the Association that is not public knowledge or publicly published. The nature of the information and the manner of disclosure are such that a reasonable man or woman would understand it to be confidential.

Self-Determination means consciously exercising one’s own free will. Acting on one’s free will that consciously recognized your inner authority.

Self-Governance means exercising of authority over oneself without outside interference. This includes having self-awareness and self-responsibility for all personal actions.

(The) Member – the man or woman who is accepting this agreement.

Waiver – the document that evidences the voluntary and intentional relinquishment of a right, claim, or privilege.

By joining aliyamd – a Private Membership Association and/or any website or Social Media Group started by, created by, or organized by the Association, I hereby accept and agree to the terms and conditions of the aliyamd Association, hereinafter “the Association”, A Private Membership Association (PMA) in the Private Domain. With the signing of this membership Agreement, I accept the offer made to become a Member of the Association. Where I reflect my private interest for services constituted through the Association, this Waiver Form is my waiver of my public and voluntary nature, and my wish to practice my private rights. This WAIVER is to protect the private nature of the Association and my agreement. I agree to the confidentiality of all services considered, without prejudice. I agree with and abide by the following Declaration of Purpose, Privacy Waiver Agreement, and the Memorandum of Understanding and accept all the terms expressed therein:

ARTICLE I. DECLARATION OF PURPOSE

OBJECTIVE:

This Association of members declares that our objective is to provide the Private Membership Association Founder and all Private Membership Association members with a safe platform in which to conduct all manner of private business and exchange between its members, and protect our rights and freedoms of choice regarding our health information and care, in a private domain guaranteed by Natural Law.

VISION:

The association’s vision is the creation of a community that is curious to learn, empowered in their knowledge of the body’s innate ability to heal, and evolving to be vibrantly alive and well in their Being. To enable this vision, the association aims to:

• Provide tools and knowledge that investigate the root cause of dis-ease and suffering

• Support members seeking self-discovery and responsibility for their well-being

• Offer a holistic, multi-dimensional approach to healing via body, energy, mind and emotion.

CODE OF CONDUCT:

The members agree to conduct themselves with mutual respect, integrity, truth, and authenticity. Both parties will reserve all rights in Equity under Natural Law. Everything stays in the private and is confidential within the association.

BENEFITS:

The Association offers all members access to our ever-evolving menu of al a cart exclusive member offerings and products within aliyamd – a Private Member Association. Offerings may include, and are not limited to: functional medicine, eastern medicine such as Ayurveda, Classical Hatha Yoga, Meditation, traditional Chinese medicine, Jin shin Jyutsu; herbology, intuitive coaching, biologic decoding, PBMT (photo-biomodulation), etc.

ENERGY EXCHAGE:

• Membership dues: a portion of your contribution from your next session booking will go towards your membership dues.

• Additional dues apply to offerings provided by the Association.

• Offerings may change from time to time and will be reflected where services are presented.

• Refund policy: Services that are not used within 60 days of purchase will expire, with no refund. Cancellations do not receive a refund. Rescheduling fees of $100 apply when changes are made to appointments within 48 hours of the scheduled appointment.

• Donations: Members may offer donations at any time to support the Association in providing offerings for other members that may not have the means of exchange for services.

MEMBER QUALIFICATIONS:

• Minimum age requirement is 18 years of age. Below 18 years of age will require the accompaniment of a trusted guardian (family member or appointed by their adult family Member) who is 18 years of age or older.

• Membership is non-transferable and is valid until revocation, cancellation, or death.

• At the discretion of the Trustees, energy exchanges for offerings can be in the form of cash, electronic payment, credit card, gold or sliver, bitcoin.

ARTICLE II. PRIVACY AGREEMENT

It is clearly understood and agreed that the Membership participation with the Association is solely between private men and women, who are not the incumbent of an office and thereby PUBLIC. Accordingly, aliyamd, a Private Membership Association, and the Member agree not to distribute, forward, disseminate, post, publish, broadcast, redistribute, sell, share, otherwise disclose private matters in any manner on or in any media not contemplated by this Agreement or otherwise authorized by express written consent.

PROTECTION OF CONFIDENTIAL INFORMATION

The Member grasps and acknowledges that Private information may be developed or obtained by the Association and that the Confidential Information is a valuable, special and unique asset which needs to be protected from improper disclosure. In consideration for participation, the Member and the Association agree as follows:

A. Non-Disclosure

Effective this date of membership, the Association and Member will hold the Private Information in confidence and will not disclose the Private Information, or the practices and procedures of the Association, to any other man or woman or person or entity, be they natural or artificial, public or private, by telephone, fax, copy, email, broadcast or publication in any media or social medial platform, picture, conversation, or any writing, recording, electronic file or transfer of information on or by any medium without the prior written consent by both Member and the Association. All records and documents remain as property of the Association, even if the Member receives a copy of them. Member agrees not to compete in any way with the practices and procedures of the Association.

B. Non-Dissemination Non-Distribution for Sale

The Association and Member agree not to distribute, forward, disseminate, record, post, publish, broadcast, redistribute, sell, share, otherwise disclose private matters in any manner on in any media not contemplated by this Agreement or otherwise authorized by express written consent.

D. Relationship of Parties

Neither the Association or Member HAVE AN OBLIGATION under this Privacy Agreement to donate for any service or item from the other party, or commercially offer any products using or incorporating the Private Information. This Privacy Agreement does not create any agency, partnership, or joint venture.

E. Limited Authorization to Use

The Member acknowledges that, as between the Association and recipient the Private Information and all related common law and/or registered copyrights and other intellectual property rights, are (and at all times will be) the property of the Association excepting any property included documents granted to the Member for Member’s private use, even if suggestions, comments, and/or ideas made by the Member are incorporated into the Private Information or related materials during the period of the Privacy Agreement.

F. Indemnity

Each party agrees to defend, indemnify, and hold harmless the each other, distributors, representatives, and employees from any and all third party (including government agencies not a party to this Privacy Agreement, or any private agreements between the parties) claims, demands, liabilities, costs and expenses, including attorney fees, costs and expenses resulting from the indemnifying party’s material breach of any duty, representation, or warranty under this Privacy Agreement. Member and the Association participate knowingly, willingly and intentionally of their own free will, act and deed and hold each other harmless except for material breach or intentional wrong.

G. Associated fees

In any mediating action between the private parties concerning this Privacy Agreement, the prevailing party shall be entitled to recover reasonable fees and costs.

H. Term

This Membership Agreement shall continue until terminated by either Party in writing. Even after that, the Member and the Association must continue to protect the Private Information that was received during the term of this Agreement from unauthorized use or disclosure. This Agreement will also terminate upon the death of the Member or upon the discontinuance or dissolution of the Association, without prejudice to either party.

I. General Provisions

This Privacy Agreement and member waiver agreement sets forth the entire understanding of the parties regarding confidentiality. The founder of the Association may make amendments to this agreement and will contact Members to notify them via email of any changes. This Agreement shall be construed exclusive under the law of equity and the common law. This Privacy agreement shall not be assignable by either party. Neither party may delegate its duties under this Privacy Agreement without the prior written consent of the other party. The confidentiality provisions of this Privacy Agreement shall remain in full force and effect at all times in accordance with the terms of this Privacy Agreement. If any provision of this Privacy Agreement is held to be invalid, unlawful or unenforceable, the remaining portions of this Privacy Agreement shall remain in full force and effect and construed so as to best effectuate the original intent and purpose of this Privacy Agreement.

ARTICLE III. MEMORANDUM OF UNDERSTANDING

ACKNOWLEDGEMENT OF SELF-RESPONSIBILITY:

I understand that the Association may provide offerings and advice regarding health care matters and does so in the capacity of a fellow Member and not in any licensed capacity, specifically not as a physician. I further understand that within the Association no doctor-client nor any other licensed professional or similar legal relationship exists between the Members. This Agreement is between Members of the Association in private relationship. I recognize and accept the concepts discussed and offered in the Association are not “public” or “licensed” practices. If I desire such licensed professional advice, I will seek such information or specialist assistance elsewhere. In confirmation, I have freely chosen to make my legal status in this Agreement - not as a public client – rather as a private Member of the Association.

The Association has chosen Aliya Rahemtulla and other persons to be named from time to time best qualified to provide advice and perform services for Members of the Association. I understand this Member provides consultations for guidance on health and well-being and other tools for the betterment of health, and I entrust them to select other Members to assist them in carrying out this benefit to the Association Members.

I further understand I am entirely responsible to consider the advice and recommendations offered to me by the Association and to educate myself on the efficacy, risk, and desirability of any recommendations. All choices are my own carefully considered decisions. I agree to hold any and each trustee, board member, staff, co-Member and any associated agency, or ministry of the Association harmless from any unintentional liability from the results of such advice or recommendations.

CHANGE OF CAPACITY:

I agree to become a member of aliyamd - a Private Member Association under Natural Law, whose members seek guidance and tools for self-discovery and well-being through holistic and natural means and demonstrate free will of choice. For the purposes of the PMA, I am voluntarily changing my capacity from that of a public person to that of a private man or woman. My activities with the Association are a private agreement that is outside of the jurisdiction of the Local, Provincial/State/Territorial, or Federal investigative or enforcement agencies and authorities. I fully agree not to pursue any course of legal action against any member of the Association.

INFORMED CONSENT:

I enter into this agreement of my own free will without any pressure or coercion or promise of results. I affirm that I do not represent any local, provincial/state/territorial or federal agency whose purpose is to regulate and approve products or services in the public domain, or to carry out any mission of enforcement, entrapment, or investigation. I have read and comprehend this agreement, and my questions have been answered fully to my satisfaction. I understand that I can withdraw from this agreement and terminate my membership in the Association at any time by writing to a leader of the Association, and that my membership can be revoked if I engage in abusive, dishonest, violent, menacing, destructive, harassing, or nuisance behaviour towards any member of the Association. By accepting this agreement, I have sought sufficient education to determine that this is the course of action I want to take for myself. By entering into this agreement, I am giving informed consent to be a member.

AGREEMENT:

This paperwork serves as a private agreement, which began the date of my joining aliyamd, a Private Membership Association. I declare that by joining this Association and/or the Associations websites and/or social media group(s), I have carefully read the whole agreement, and I comprehend and agree with it. I acknowledge, comprehend, and take full responsibility for my actions by consenting to this agreement. Should I break this agreement, I recognize that my member benefits and participation in the Association may be terminated.

Thus, I hereby certify, attest and warrant that I, being age of majority with sound mind and sufficient intellect and reasoning to comprehend both the terms of this Agreement and its significance. I have carefully read and understood the plain language of the above and foregoing aliyamd Private Membership Association Waiver and Agreement and voluntarily accept the terms herein. I fully understand and agree with the terms and hereby intend these terms and this Agreement to bind myself knowingly, willingly, and intentionally as an act of my own free will.
